Privacy Policy

  1. Information Collected Won’t be Given to Third Parties.
    Speedmark Transportation, Speedmark LTD, Speedmark Consolidation, Rex and all affiliates, subsidiaries or other related companies (hereinafter called “Speedmark”) will not sell, share, or rent personal information to any third parties not affiliated with Speedmark unless you have provided consent for such sharing. Speedmark will only use information in ways disclosed in this statement or agreed upon individually or in separate agreements.
  2. Types of information captured
    Speedmark does not collect personal information about you unless you voluntarily provide that information to us or you choose a service (i.e. Speed – Management) that requires you submit personal information in order to receive the selected service. Speedmark requests information from the user on our ‘contact us’ form and our ‘employment application’ form. Personal information may include your name, title, company, address, e-mail address, or phone number. Unless, specifically stated, we do not require personal information to obtain access to any part of the Speedmark Websites.
    Speedmark’s web servers may collect the date and time of visit, referring address, type of Internet browser, and the IP addresses of visitors to the website. The information may be used to measure the number of visits, average time of visit, pages viewed, etc. in order to measure the use of the Speedmark Website and to help develop and improve internet-based content and services. Speedmark does not obtain any personal information from your IP address.
    Data Transfer
    Information sent via the Internet (“Contact Us” and “Employment Application”) is not secure. This data can be accessed by unauthorized third parties leading to disclosures, changes in content or technical failure. Speedmark is not responsible or liable for the data while in transit via the Internet to us. Please use other means of communication if you find necessary for security reasons.
  3. How We Use the information
    The information collected helps us identify the type of webs its content our customers value most. We used this information to market and improve the web site and our services. We may also use personal information collected through our ‘contact us’ form or ‘employment application’ form to contact you in response to your comments or questions regarding Speedmark or to provide you with information about your account and additional products and services that we think may be of interest to you. We require our suppliers to conduct activities consistent with this policy and our requirements.
  4. Cookies
    While viewing certain areas of the Speedmark website, information, “Cookies” may be stored on your computer. Cookies are pieces of information that are stored by a user’s browser on his or her computer’s hard drive to track and target the interests of Speedmark users and to enhance the User’s online experience of the site. Speedmark does not obtain any personal information from the cookies that may be placed on your computer. If you prefer, cookies may be removed from your hard drive. Please check with your browser provider for more information on removing cookies or adjust your privacy settings.
  5. Data Security
    Within Speedmark your personal data will be transmitted and stored in a protected environment (i.e. firewalls). We will take all appropriate precautions in order not to allow your personal data to be viewed by any third party other than those who have been engaged by Speedmark to provide specific services for which the user has signed up for. In connection with these offerings and business operations, our service providers may have access to your personal information for use for a limited time in connection with these business activities. Where we utilize third parties for the processing of any personal information, we implement reasonable contractual and technical protections limiting the use of that information to the Speedmark specified purposes. These parties are not allowed to use personally identifiable information except for the purpose of providing these services. We will only disclose your data to other third parties if we have a reasonable good faith belief that access, use, preservation or disclosure of such information is necessary (a) because Speedmark is compelled to do so for legal or regulatory purposes, such as subpoenas or court orders, or in compliance with applicable laws, (b) to detect, prevent, or otherwise address fraud, security or technical issues, or (c) to protect against imminent harm to the rights, property or safety of Speedmark or its users as required or permitted by law.
    Except as stated above, any communication or material you transmit to or post on the Speedmark Website by electronic mail or otherwise, is and will be treated as, non-confidential and nonproprietary and is done at your own risk. Any such communication transmitted or posted to the Speedmark Website shall become the property of Speedmark and may be used for any purpose.
  6. Log In Required Areas
    Areas such as ‘Speed Trace’ or ‘Speed Manage’ require “user name” and “password”, which are used to protect your account from unauthorized access. Speedmark has security policies and procedures in place to protect your personal information from loss, misuse, or alteration. When you are logged into, Speed-Trace or Speed-Manage, your personal information is protected by current technology that uses a secure socket layer (SSL) protocol with a required 128-bit encryption key. SSL is an encoding algorithm that encrypts information passed between your computer and Speedmark in an effort to prevent unauthorized access of your personal information. In addition, our personnel who have access to your data are required to maintain the confidentiality of your personal information.
    If you have a user name and password for access to the non-public areas of the Speedmark Website, you are solely responsible for all activities that occur in connection with your user name and/or password. Speedmark recommends that you take steps to protect the confidentiality of your user name and password. If you become aware of any disclosure, loss, theft or unauthorized use of your user name and/or password, please notify Speedmark immediately.
  7. Email Communication
    If you provide your e-mail address to Speedmark, you consent to our use of your e-mail to notify you of information that may affect your account, or to provide you with the information you have specifically requested. If you send us an e-mail message, you also consent to our use of your e-mail address to answer the message we received from you. Your e-mail address will not be used for any purpose other than those listed above.
  8. Legal Disclaimer
    These web pages may contain inadvertent inaccuracies or typographical errors, and given the inherent hazards of electronic communication, there may be delays, omissions or inaccuracies in the information contained in these web pages. These will be corrected at Speedmark’s discretion, as they are found.
    While every attempt has been made to ensure that the information contained in these web pages is accurate and has been obtained from reliable sources, Speedmark is not responsible for any errors or omissions, or for the results obtained from the use of this information. All information in these web pages is provided “as is”, with no guarantee of completeness, accuracy, timeliness or the results obtained from the use of this information, and without warranty of any kind, express or implied, including, but not limited to warranties of performance, merchantability and fitness for a particular purpose. In no event will Speedmark, related corporations, agents or employees thereof be liable to you or anyone else for any decision made or action taken in reliance on the information in these web pages or for any consequential, special, or similar damages.
    Speedmark processes personal information only for the purposes for which it was collected and in accordance with this Privacy Policy or any applicable service-specific privacy notice. We depend on users to update or correct their personal information whenever necessary.
  9. Linked Websites
    The Speedmark website contains links to other websites. These links can connect to other web pages maintained by third parties over whom Speedmark has no control. These links are meant sole for your convenience. Speedmark makes no representations as to the accuracy or any other aspect of information contained in other web pages nor has any control over or responsibility for the information collecting practices of the linked websites. Your use of the linked websites will be governed by the privacy policies of those sites and not by Speedmark’s Privacy Policy.
  10. Notification of changes
    Speedmark may make changes to this U.S. Privacy Policy at any time, and without prior notice. Any changes to the Speedmark Privacy Policy will be posted on the website and, if the changes are significant, we will provide a more prominent notice, including for certain services, e-mail notification of Privacy Policy changes. A significant change will be posted thirty (30) days prior to taking effect. We therefore invite you to review this policy regularly to familiarize yourself with any changes. We will keep prior versions of this Privacy Policy in an archive for your review.
  11. Terms of Use, Notices and Revisions
    Your use of Speedmark, and any disputes arising from it, is subject to this Privacy Policy as well as our Terms of Use and all of its dispute resolution provisions including arbitration, limitation on damages and choice of law.
  12. Biometric Information Privacy Policy
    Speedmark Transportation Inc. (“Speedmark”) has adopted this Biometric Information Privacy Policy for each of its offices located in the United States.  Speedmark reserves the right to modify this policy from time to time as it deems necessary to effectuate Speedmark’s policies as applicable technologies, laws and regulations develop.Biometric Data Defined
    As used in this policy, biometric data includes “biometric identifiers” and “biometric information” as defined in the Illinois Biometric Information Privacy Act, 740 ILCS § 14/1, et seq. “Biometric identifier” means a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry. Biometric identifiers do not include writing samples, written signatures, photographs, human biological samples used for valid scientific testing or screening, demographic data, tattoo descriptions, or physical descriptions such as height, weight, hair color, or eye color. Biometric identifiers do not include information captured from a patient in a health care setting or information collected, used, or stored for health care treatment, payment, or operations under the federal Health Insurance Portability and Accountability Act of 1996. “Biometric information” means any information, regardless of how it is captured, converted, stored, or shared, based on an individual’s biometric identifier used to identify an individual. Biometric information does not include information derived from items or procedures excluded under the definition of biometric identifiers.

    Purpose for Collection of Biometric Data

    Speedmark uses biometric data solely for employee identification, attendance tracking, and fraud prevention. Currently, Speedmark does not share biometric information with the manufacturer and/or licensor of its time and attendance equipment and software. Speedmark reserves the right to share biometric information with the manufacturer and/or licensor of its time and attendance equipment and software if it is required to do so for employee identification, attendance tracking, and fraud prevention.When Speedmark collects, captures, or otherwise obtains biometric data relating to an employee, Speedmark will:

    a. Inform the employee in writing that Speedmark is collecting, capturing, or otherwise obtaining the employee’s biometric data;
    b. Inform the employee in writing of the specific purpose and length of time for which the employee’s biometric data is being collected, stored, and used; and
    c. Receive a written release signed by the employee (or his or her legally authorized representative) authorizing Speedmark to collect, store, and use the employee’s biometric data for the specific purposes disclosed by Speedmark.

    Speedmark will not sell, lease, trade, or otherwise profit from employees’ biometric data.

    Disclosure
    Speedmark will not disclose or disseminate any biometric data to anyone unless:

    a. First obtaining written employee consent to such disclosure or dissemination;
    b. The disclosed data completes a financial transaction requested or authorized by the employee;
    c. Disclosure is required by state or federal law or municipal ordinance; or
    d. Disclosure is required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.

    Retention Schedule

    Speedmark shall retain employee biometric data only until the first of the following occurs:

    a. Ninety (90) days after the initial purpose for collecting or obtaining such biometric data no longer exists, such as the termination of the employee’s employment with the Company, or the employee moves to a role within the Company for which the biometric data is not used; or

    b. Within 3 years of the employee’s last interaction with the Company.

    Currently, Speedmark does not share biometric information with the manufacturer and/or licensor of its time and attendance equipment and software. Should it do so, Speedmark shall request that the licensor of Speedmark’s time and attendance equipment and software permanently destroy such data when Speedmark’s retention of the data ceases. Data Storage Speedmark shall use a reasonable standard of care to store, transmit and protect from disclosure any paper or electronic biometric data collected. Such storage, transmission, and protection from disclosure shall be performed in a manner that is the same as or more protective than the manner in which Speedmark stores, transmits and protects from disclosure other confidential and sensitive information, including personal information that can be used to uniquely identify an individual or an individual’s account or property, such as genetic markers, genetic testing information, account numbers, PINs, driver’s license numbers and social security numbers.
